FOIA Request for Access to UFO Whistleblower Documents Denied by Intelligence Agency

The Black Vault’s Freedom of Information Act (FOIA) request for records related to “UFO WhistleblowerDavid Charles Grusch has been denied by the Office of the Director of National Intelligence (ODNI). This case highlights the ongoing struggle for access to information in matters of public interest, particularly in the realm of unidentified aerial phenomena.

The request, filed under case number DF-2023-00219 on June 9, 2023, sought to obtain a wide array of records concerning Grusch’s communications with the Intelligence Community Inspector General (ICIG). Specifically, it aimed to uncover correspondence, reports, memos, notes, transcripts, photos, videos, and other documents from around May 2022, a period of heightened interest in Grusch’s revelations about UFOs as that is when he is said to have submitted his original “Disclosure of Urgent Concern(s), Complaint of Reprisal” to the ICIG.

ODNI’s response, received on January 8, 2024, (dated January 5) cited a FOIA exemption relating to national security and refused to confirm or deny the existence of the records. The letter referenced Section 103H(g)(3)(a) of the National Security Act of 1947, which is often employed in cases where acknowledging the existence of information could have security implications.

Challenging this stance, The Black Vault filed an appeal, contesting the applicability of the exemption. That appeal, filed on January 8, 2024,  and remains open as of the publishing of this article, emphasizes that Grusch’s public disclosures, including his participation in a congressional hearing and numerous media interviews, mitigate the need for confidentiality. It argues that Grusch’s openness about his experiences and communications with the ICIG has essentially waived the right to privacy in this context.
