<h4 style="text-align: center;">District Attorney Bragg Announces 34-Count Felony Indictment of Former President Donald J. Trump</h4>
<p>Manhattan District Attorney Alvin L. Bragg, Jr. today announced the indictment of DONALD J. TRUMP, 76, for falsifying New York business records in order to conceal damaging information and unlawful activity from American voters before and after the 2016 election. During the election, TRUMP and others employed a “catch and kill” scheme to identify, purchase, and bury negative information about him and boost his electoral prospects. TRUMP then went to great lengths to hide this conduct, causing dozens of false entries in business records to conceal criminal activity, including attempts to violate state and federal election laws.</p>
<p>TRUMP is charged in a New York State Supreme Court indictment with 34 counts of Falsifying Business Records in the First Degree.</p>
<p>“The People of the State of New York allege that Donald J. Trump repeatedly and fraudulently falsified New York business records to conceal crimes that hid damaging information from the voting public during the 2016 presidential election,” said District Attorney Bragg. “Manhattan is home to the country’s most significant business market. We cannot allow New York businesses to manipulate their records to cover up criminal conduct. As the Statement of Facts describes, the trail of money and lies exposes a pattern that, the People allege, violates one of New York’s basic and fundamental business laws. As this office has done time and time again, we today uphold our solemn responsibility to ensure that everyone stands equal before the law.”</p>
<p>According to court documents and statements made on the record in court, from August 2015 to December 2017, TRUMP orchestrated his “catch and kill” scheme through a series of payments that he then concealed through months of false business entries.</p>
<p>In one instance, American Media Inc. (“AMI”), paid $30,000 to a former Trump Tower doorman, who claimed to have a story about a child TRUMP had out of wedlock.</p>
<p>In a second instance, AMI paid $150,000 to a woman who alleged she had a sexual relationship with TRUMP. When TRUMP explicitly directed a lawyer who then worked for the Trump Organization as TRUMP’s Special Counsel (“Special Counsel”) to reimburse AMI in cash, the Special Counsel indicated to TRUMP that the payment should be made via a shell company and not by cash. AMI ultimately declined to accept reimbursement after consulting their counsel. AMI, which later admitted its conduct was unlawful in an agreement with federal prosecutors, made false entries in its business records concerning the true purpose of the $150,000 payment.</p>
<p>In a third instance – 12 days before the presidential general election – the Special Counsel wired $130,000 to an attorney for an adult film actress. The Special Counsel, who has since pleaded guilty and served time in prison for making the illegal campaign contribution, made the payment through a shell corporation funded through a bank in Manhattan.</p>
<p>After winning the election, TRUMP reimbursed the Special Counsel through a series of monthly checks, first from the Donald J. Trump Revocable Trust – created in New York to hold the Trump Organization’s assets during TRUMP’s presidency – and later from TRUMP’s bank account. In total, 11 checks were issued for a phony purpose. Nine of those checks were signed by TRUMP. Each check was processed by the Trump Organization and illegally disguised as a payment for legal services rendered pursuant to a non-existent retainer agreement. In total, 34 false entries were made in New York business records to conceal the initial covert $130,000 payment. Further, participants in the scheme took steps that mischaracterized, for tax purposes, the true nature of the reimbursements.</p>
<p>Assistant D.A.s Catherine McCaw (Counsel to the Investigation Division), Katherine Ellis (Major Economic Crimes Bureau), Rebecca Mangold (Major Economic Crimes Bureau), Christopher Conroy (Senior Advisor to the Investigation Division), Susan Hoffinger (Chief of the Investigation Division), and Matthew Colangelo (Senior Counsel to the District Attorney) are handling the prosecution of this case with the assistance of Peter Pope (Executive Assistant D.A.), Steven Wu (Executive Assistant D.A. and Chief of the Appeals Division), and Alan Gadlin (Deputy Chief of the Appeals Division).</p>

<p style="padding-left: 40px;"><em><strong>At the request of then Secretary of the U.S. Department of the Interior David Bernhardt and Members of Congress, we reviewed the actions the U.S. Park Police (USPP) took to disperse protesters in and around Lafayette Park in Washington, DC, on June 1, 2020. Our review focused on events that occurred in and around the park from May 29 through June 3 amid the ongoing Black Lives Matter protests. We sought to describe what occurred primarily from an operational perspective, including how and when the USPP, in coordination with its law enforcement partners, developed and executed its plan to clear the park and the USPP’s reasons for dispersing protesters from the area. We also sought to determine whether the warnings the USPP provided to protesters before it executed the plan complied with applicable guidance. We did not review as part of this project individual uses of force by USPP officers; these actions are the subject of separate inquiries or ongoing lawsuits.</strong></em></p>
<p style="padding-left: 40px;"><em><strong>Protests began in and around Lafayette Park on May 29, 2020. On May 30, the USPP and U.S. Secret Service established a unified command to coordinate the law enforcement response to the protests. From May 30 to 31, at least 49 USPP officers were injured while policing the protests, and Federal and private property was vandalized.</strong></em></p>
<p style="padding-left: 40px;"><em><strong>On the morning of June 1, the Secret Service procured antiscale fencing to establish a more secure perimeter around Lafayette Park that was to be delivered and installed that same day. The USPP, in coordination with the Secret Service, determined that it was necessary to clear protesters from the area in and around the park to enable the contractor’s employees to safely install the fence. The USPP planned to implement the operation as soon as the fencing materials and sufficient law enforcement officers arrived at the park. Six other law enforcement agencies assisted the USPP and the Secret Service in the operation to clear and secure areas near the park.</strong></em></p>
<p style="padding-left: 40px;"><em><strong>The operation began at 6:23 p.m. and was completed by 6:50 p.m. Shortly thereafter, at 7:01 p.m., President Trump walked from the White House through Lafayette Park to St. John’s Church. At 7:30 p.m., the contractor began assembling and installing the antiscale fence and completed the work by approximately 12:30 a.m. on June 2.</strong></em></p>
<p style="padding-left: 40px;"><em><strong>We found that the USPP had the authority and discretion to clear Lafayette Park and the surrounding areas on June 1. The evidence we obtained did not support a finding that the USPP cleared the park to allow the President to survey the damage and walk to St. John’s Church. Instead, the evidence we reviewed showed that the USPP cleared the park to allow the contractor to safely install the antiscale fencing in response to destruction of property and injury to officers occurring on May 30 and 31. Further, the evidence showed that the USPP did not know about the President’s potential movement until mid- to late afternoon on June 1—hours after it had begun developing its operational plan and the fencing contractor had arrived in the park.</strong></em></p>
<p style="padding-left: 40px;"><em><strong>We also found that although the USPP used a sound-amplifying long-range acoustic device to issue three dispersal warnings to the crowd on June 1, not everyone could hear the warnings. Furthermore, we found that the USPP does not have a detailed dispersal warning policy applicable to operations like the one that occurred on June 1 and that this may have led to the ineffective warnings issued to the crowd that day.</strong></em></p>
<p style="padding-left: 40px;"><em><strong>Finally, we found that the USPP and the Secret Service did not use a shared radio channel to communicate, that the USPP primarily conveyed information orally to assisting law enforcement entities, that an assisting law enforcement entity arrived late and may not have received a full briefing on the rules of engagement, and that several law enforcement officers could not clearly hear the incident commander’s dispersal warnings. These weaknesses in communication and coordination may have contributed to confusion during the operation and the use of tactics that appeared inconsistent with the incident commander’s operational plan.</strong></em></p>
<p style="padding-left: 40px;"><em><strong>Given the lack of a specific policy, we recommend that the USPP develop a detailed policy for protests and other events of the type that occurred on June 1 and improve its field communication procedures to better manage multiagency operations.</strong></em></p>

<p><b>WASHINGTON</b> – Today, as part of the Senate Judiciary Committee’s ongoing investigation into the Crossfire Hurricane investigation and related FISA abuses, Chairman Lindsey Graham (R- South Carolina) released two recently declassified documents that significantly undercut the reliability of the Steele dossier and the accuracy and reliability of many of the factual assertions in the Carter Page FISA applications.</p>
<p><b>“I’m very pleased the investigation in the Senate Judiciary Committee has been able to secure the declassification of these important documents,” </b>said Chairman Graham.<b> “I want to thank Attorney General Barr for releasing these documents and allowing the American People to judge for themselves.</b></p>
<p><b>“What have we learned from the release of these two documents by the Department of Justice? Number one, it is clear to me that the memo regarding the FBI interview of the primary sub-source in January 2017 should have required the system to stop and reevaluate the case against Mr. Page.</b></p>
<p><b>“Most importantly after this interview of the sub-source and the subsequent memo detailing the contents of the interview, it was a miscarriage of justice for the FBI and the Department of Justice to continue to seek a FISA warrant against Carter Page in April and June of 2017.</b></p>
<p><b>“The dossier was a critical document to justify a FISA warrant against Mr. Page and this DOJ memo clearly indicates that the reliability of the dossier was completely destroyed after the interview with the primary sub-source in January 2017. Those who knew or should have known of this development and continued to pursue a FISA warrant against Mr. Page anyway are in deep legal jeopardy in my view.</b></p>
<p><b>“Secondly, the comments of Peter Strzok regarding the February 14 New York Times article are devastating in that they are an admission that there was no reliable evidence that anyone from the Trump Campaign was working with Russian Intelligence Agencies in any form.</b></p>
<p><b>“The statements by Mr. Strzok question the entire premise of the FBI’s investigation of the Trump Campaign and make it even more outrageous that the Mueller team continued this investigation for almost two and a half years. Moreover, the statements by Strzok raise troubling questions as to whether the FBI was impermissibly unmasking and analyzing intelligence gathered on U.S. persons.</b></p>
<p><b>“These documents, which I have long sought, tell a damning story for anyone who’s interested in trying to find the truth behind the corrupt nature of the FBI’s investigation into the Trump campaign in 2016 and beyond.”</b></p>
<p>The first document is a <img decoding="async" src="https://www.theblackvault.com/images/pdf.gif" /> <a href="https://documents2.theblackvault.com/documents/senate/February92017ElectronicCommunication.pdf">57-page summary</a> [59 Pages, 17MB] of a three-day interview the FBI conducted with Christopher Steele’s so-called “Primary Sub-source” in January of 2017.</p>

<li>This document not only demonstrates how unsubstantiated and unreliable the Steele dossier was, it shows that the FBI was on notice of the dossier’s credibility problems and sought two more FISA application renewals after gaining this awareness.</li>
</ul>
<ul>
<li>The document reveals that the primary “source” of Steele’s election reporting was not some well-connected current or former Russian official, but a non-Russian based contract employee of Christopher Steele’s firm. Moreover, it demonstrates that the information that Steele’s primary source provided him was second and third-hand information and rumor at best.</li>
</ul>
<ul>
<li>Critically, the document shows that Steele’s “Primary Sub-source” disagreed with and was surprised by how information he gave Steele was then conveyed by Steele in the Steele dossier. For instance, the “Primary Sub-source”: did not recall or did not know where some of the information attributed to him or his sources came from; was never told about or never mentioned to Steele certain information attributed to him or his sources; he said that Steele re-characterized some of the information to make it more substantiated and less attenuated than it really was; that he would have described his sources differently; and, that Steele implied direct access to information where the access to information was indirect.</li>
</ul>
<ul>
<li>In total, this document demonstrates that information from the Steele dossier, which “played a central and essential role” in the FISA warrants on Carter Page, should never have been presented to the FISA court.</li>
</ul>
<p>The second document contains <img decoding="async" src="https://www.theblackvault.com/images/pdf.gif" /> <a href="https://documents2.theblackvault.com/documents/senate/AnnotatedNewYorkTimesArticle.pdf">Peter Strzok’s type-written comments</a> [5 Pages, 2MB] disagreeing with assertions made in a <i>New York Times</i> article about alleged Russian intelligence ties to the Trump campaign.</p>

<li>The document demonstrates that Peter Strzok and others in FBI leadership positions must have been aware of the issues with the Steele dossier that the FBI’s interview with Steele’s “Primary Sub-source” revealed, because Strzok commented that “[r]ecent interviews and investigation, however, reveal Steele may not be in a position to judge the reliability of his sub-source network.”</li>
</ul>

<li>The document further shows that the FBI’s assertion to the FISA court that “the FBI believes that Russia’s efforts to influence U.S. policy were likely being coordinated between the RIS [Russian Intelligence Services] and Page, and possibly others” appears to be a misrepresentation. This is because, in his comments on the <i>Times</i> article, Strzok asserts that “[w]e have not seen evidence of any individuals affiliated with the Trump team in contact with IOs [Intelligence Officials]. . . . We are unaware of ANY Trump advisors engaging in conversations with Russian intelligence officials.”</li>
</ul>
<ul>
<li>The document also indicates that the FBI may have been using foreign intelligence gathering techniques to impermissibly unmask and analyze existing and future intelligence collection regarding U.S. persons associated with the Trump campaign: “Both the CIA and NSA are aware of our subjects and throughout the summer we provided them names and selectors for queries of their holdings as well as prospective collection.” The quote does not provide enough information to fully understand exactly what the FBI was doing but impermissible unmasking and analysis of existing and future incidental intelligence collection of U.S. persons would be troubling.</li>
</ul>
<ul>
<li>The document also raises questions as to whether the FBI was properly using intelligence techniques and databases “throughout the summer” considering that the earliest formal investigation of a U.S. person associated with the Trump campaign was not officially opened until July 31, 2016.</li>

<p>“Today, GAO issued a legal decision concluding that the Office of Management and Budget violated the law when it withheld approximately $214 million appropriated to DOD for security assistance to Ukraine.  The President has narrow, limited authority to withhold appropriations under the Impoundment Control Act of 1974.  OMB told GAO that it withheld the funds to ensure that they were not spent “in a manner that could conflict with the President’s foreign policy.”  The law does not permit OMB to withhold funds for &#8220;policy reasons.”</p>

<p>The House Committee on the Judiciary has completed the consideration of two articles of impeachment against President Donald J. Trump. The first article charges that the President used the<br />
powers of his office to solicit and pressure a foreign government, Ukraine, to investigate his domestic political rival and interfere in the upcoming United States Presidential elections. The second article charges that the President categorically obstructed the Congressional impeachment inquiry into his conduct. Taken together, the articles charge that President Trump has placed his personal, political interests above our national security, our free and fair elections, and our system of checks and balances. He has engaged in a pattern of misconduct that will continue if left unchecked. Accordingly, President Trump should be impeached and removed from office.</p>

Trump&#8217;s career, branding efforts, lifestyle and outspoken manner helped make him a celebrity, a status amplified by the success of his NBC reality show, The Apprentice.</strong></em></p>
<p style="padding-left: 30px;"><em><strong>Trump is a son of Fred Trump, a New York City real estate developer. He worked for his father&#8217;s firm, Elizabeth Trump &amp; Son, while attending the Wharton School of the University of Pennsylvania, and officially joined the company in 1968.
