{"id":3317,"date":"2020-03-16T05:30:35","date_gmt":"2020-03-16T05:30:35","guid":{"rendered":"http:\/\/www.theblackvault.com\/documentarchive\/?p=3317"},"modified":"2020-03-23T12:54:02","modified_gmt":"2020-03-23T12:54:02","slug":"designated-agency-ethics-official-daeo-memorandums","status":"publish","type":"post","link":"https:\/\/www.theblackvault.com\/documentarchive\/designated-agency-ethics-official-daeo-memorandums\/","title":{"rendered":"Designated Agency Ethics Official (DAEO) Memorandums"},"content":{"rendered":"<h3>Background<\/h3>\n<p>The Ethics in Government Act of 1978, borne out of the Watergate scandal, established the Office of Government Ethics and the position of a Designated Agency Ethics Official in each executive branch agency.<\/p>\n<p>The Act is intended to promote the integrity of public officials and institutions. To that end, the Act created mandatory public disclosure of certain designated public officials&#8217; financial and employment history and restricted lobbying activities of public officials after leaving office.<\/p>\n<p>According to CFR 5\u00a0\u00a7 2638.203, the\u00a0Duties of the designated agency ethics official are:<\/p>\n<p class=\"psection-1\" style=\"padding-left: 30px;\"><em><span id=\"a\" class=\"enumxml\">(a)<\/span> <span class=\"et03\">In general.<\/span> The designated agency ethics official shall coordinate and manage the agency&#8217;s ethics program. The program consists generally of:<\/em><\/p>\n<p class=\"psection-2\" style=\"padding-left: 30px;\"><em><span id=\"a_1\" class=\"enumxml\">(1)<\/span> Liaison with the Office of Government Ethics;<\/em><\/p>\n<p class=\"psection-2\" style=\"padding-left: 30px;\"><em><span id=\"a_2\" class=\"enumxml\">(2)<\/span> Review of financial disclosure reports;<\/em><\/p>\n<p class=\"psection-2\" style=\"padding-left: 30px;\"><em><span id=\"a_3\" class=\"enumxml\">(3)<\/span> Initiation and maintenance of ethics education and training programs; and<\/em><\/p>\n<p class=\"psection-2\" style=\"padding-left: 30px;\"><em><span id=\"a_4\" class=\"enumxml\">(4)<\/span> Monitoring administrative actions and sanctions.<\/em><\/p>\n<p class=\"psection-2\" style=\"padding-left: 30px;\"><em>(Additional Background is below&#8230;)<\/em><\/p>\n<h3 class=\"psection-2\">DAEO Memorandums<\/h3>\n<p>In mid 2016, I began filing FOIA requests for memorandums issued from various agency DAEOs. 01\/01\/15 &#8211; Circa 09\/17 [55 Pages, 3MB]<\/p>\n<h3>Additional Information<\/h3>\n<p><em>(&#8230;Continued from above)<\/em><\/p>\n<p class=\"psection-1\" style=\"padding-left: 30px;\"><em><span id=\"b\" class=\"enumxml\">(b)<\/span> <span class=\"et03\">Program elements.<\/span> In carrying out this program on behalf of the head of the agency, the designated agency ethics official shall ensure that:<\/em><\/p>\n<p class=\"psection-2\" style=\"padding-left: 30px;\"><em><span id=\"b_1\" class=\"enumxml\">(1)<\/span> Close liaison with the Office of Government Ethics concerning the agency&#8217;s ethics program is developed and maintained;<\/em><\/p>\n<p class=\"psection-2\" style=\"padding-left: 30px;\"><em><span id=\"b_2\" class=\"enumxml\">(2)<\/span> An effective system and procedure for the collection, filing, review, and, when applicable, public inspection of the financial disclosure reports as required by title II of the Act, Executive Order 11222, and other applicable statutes and regulations is developed and properly administered;<\/em><\/p>\n<p class=\"psection-2\" style=\"padding-left: 30px;\"><em><span id=\"b_3\" class=\"enumxml\">(3)<\/span> The financial disclosure reports of Presidential nominees to agency positions submitted prior to Senate confirmation hearings pursuant to \u00a7 2634.605(c) of part 2634 are certified personally by him or herself or alternate designated agency ethics official in his or her absence;<\/em><\/p>\n<p class=\"psection-2\" style=\"padding-left: 30px;\"><em><span id=\"b_4\" class=\"enumxml\">(4)<\/span> All financial disclosure reports submitted by employees and filed in bureaus and regional offices, as well as those submitted and filed at the agency&#8217;s headquarters, are properly maintained and effectively and consistently reviewed for conformance with all applicable laws and statutes;<\/em><\/p>\n<p class=\"psection-2\" style=\"padding-left: 30px;\"><em><span id=\"b_5\" class=\"enumxml\">(5)<\/span> A list of those circumstances or situations which have resulted or may result in noncompliance with ethics laws and regulations is developed, maintained and published within the agency as required by \u00a7 206(b)(7) of the Act and made available for public inspection;<\/em><\/p>\n<p class=\"psection-2\" style=\"padding-left: 30px;\"><em><span id=\"b_6\" class=\"enumxml\">(6)<\/span> An education program for agency employees concerning all ethics and standards of conduct matters is developed and conducted in accordance with subpart G, Executive Agency Ethics Training Programs, of this part.<\/em><\/p>\n<p class=\"psection-2\" style=\"padding-left: 30px;\"><em><span id=\"b_7\" class=\"enumxml\">(7)<\/span> A counseling program for agency employees concerning all ethics and standards of conduct matters including post employment matters, is developed and conducted;<\/em><\/p>\n<p class=\"psection-2\" style=\"padding-left: 30px;\"><em><span id=\"b_8\" class=\"enumxml\">(8)<\/span> Records are kept, when appropriate, on advice rendered;<\/em><\/p>\n<p class=\"psection-2\" style=\"padding-left: 30px;\"><em><span id=\"b_9\" class=\"enumxml\">(9)<\/span> Prompt and effective action including administrative action is undertaken to remedy:<\/em><\/p>\n<p class=\"psection-3\" style=\"padding-left: 30px;\"><em><span id=\"b_9_i\" class=\"enumxml\">(i)<\/span> Violations or potential violations, or appearances thereof, of the agency&#8217;s standards of conduct including post employment regulations;<\/em><\/p>\n<p class=\"psection-3\" style=\"padding-left: 30px;\"><em><span id=\"b_9_ii\" class=\"enumxml\">(ii)<\/span> The failure to file a financial disclosure report or portions thereof;<\/em><\/p>\n<p class=\"psection-3\" style=\"padding-left: 30px;\"><em><span id=\"b_9_iii\" class=\"enumxml\">(iii)<\/span> Potential or actual conflicts of interests, or appearances thereof, which were disclosed on a financial disclosure report; and<\/em><\/p>\n<p class=\"psection-3\" style=\"padding-left: 30px;\"><em><span id=\"b_9_iv\" class=\"enumxml\">(iv)<\/span> Potential or actual violations of other laws governing the conduct or financial holdings of officers or employees of that agency, and<\/em><\/p>\n<div class=\"fp\" style=\"padding-left: 30px;\"><em>that a follow-up is made to ensure that actions ordered, including divestiture and disqualification, have been taken;<\/em><\/div>\n<p class=\"psection-2\" style=\"padding-left: 30px;\"><em><span id=\"b_10\" class=\"enumxml\">(10)<\/span> The agency&#8217;s standards of conduct regulations, financial disclosure systems, and post-employment enforcement systems are evaluated periodically to determine their adequacy and effectiveness in relation to current agency responsibilities;<\/em><\/p>\n<p class=\"psection-2\" style=\"padding-left: 30px;\"><em><span id=\"b_11\" class=\"enumxml\">(11)<\/span> Information developed by internal audit and review staff, the Office of the Inspector General, if any, or other audit groups is reviewed to determine whether such information discloses a need for revising agency standards of conduct or for taking prompt corrective action to remedy actual or potential conflict of interest situations;<\/em><\/p>\n<p class=\"psection-2\" style=\"padding-left: 30px;\"><em><span id=\"b_12\" class=\"enumxml\">(12)<\/span> The services of the agency&#8217;s Office of the Inspector General, if any, are utilized when appropriate, including the referral of matters to and acceptance of matters from that Office;<\/em><\/p>\n<p class=\"psection-2\" style=\"padding-left: 30px;\"><em><span id=\"b_13\" class=\"enumxml\">(13)<\/span> A list of those persons to whom delegations of authority are made pursuant to \u00a7 2638.204(a) is maintained and made available to the Office of Government Ethics, upon request;
