<p>MEMORANDUM FOR THE ATTORNEY GENERAL<br />
THE DIRECTOR OF NATIONAL INTELLIGENCE<br />
THE DIRECTOR OF THE CENTRAL INTELLIGENCE AGENCY</p>
<p>SUBJECT:    Declassification of Certain Materials Related to the FBI’s Crossfire Hurricane Investigation</p>
<p>By the authority vested in me as President by the Constitution and the laws of the United States of America, I hereby direct the following:</p>
<p><u>Section</u> <u>1</u>.  <u>Declassification and Release</u>.    At my request, on December 30, 2020, the Department of Justice provided the White House with a binder of materials related to the Federal Bureau of Investigation’s Crossfire Hurricane investigation.  Portions of the documents in the binder have remained classified and have not been released to the Congress or the public.  I requested the documents so that a declassification review could be performed and so I could determine to what extent materials in the binder should be released in unclassified form.</p>
<p>I determined that the materials in that binder should be declassified to the maximum extent possible.  In response, and as part of the iterative process of the declassification review, under a cover letter dated January 17, 2021, the Federal Bureau of Investigation noted its continuing objection to any further declassification of the materials in the binder and also, on the basis of a review that included Intelligence Community equities, identified the passages that it believed it was most crucial to keep from public disclosure.  I have determined to accept the redactions proposed for continued classification by the FBI in that January 17 submission.</p>
<p>I hereby declassify the remaining materials in the binder.  This is my final determination under the declassification review and I have directed the Attorney General to implement the redactions proposed in the FBI’s January 17 submission and return to the White House an appropriately redacted copy.</p>
<p>My decision to declassify materials within the binder is subject to the limits identified above and does not extend to materials that must be protected from disclosure pursuant to orders of the Foreign Intelligence Surveillance Court and does not require the disclosure of certain personally identifiable information or any other materials that must be protected from disclosure under applicable law.  Accordingly, at my direction, the Attorney General has conducted an appropriate review to ensure that materials provided in the binder may be disclosed by the White House in accordance with applicable law.</p>
<p><u>Sec</u>. <u>2</u>.  <u>General Provisions</u>.   (a)  Nothing in this memorandum shall be construed to impair or otherwise affect:</p>
<p>(i)   the authority granted by law to an executive department or agency, or the head thereof; or</p>
<p>(ii)  the functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals.</p>
<p>(b)  This memorandum shall be implemented consistent with applicable law and subject to the availability of appropriations.</p>
<p>(c)  This memorandum is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.</p>
<p>(d)  The Attorney General is authorized and directed to publish this memorandum in the Federal Register.</p>

<p style="padding-left: 40px;"><em><strong>The Senate Judiciary Committee, chaired by U.S. Senator Lindsey Graham (R-South Carolina), today released transcripts of interviews conducted during its inquiry into the origins and aftermath of the Crossfire Hurricane Investigation.</strong></em></p>
<p style="padding-left: 40px;"><em><strong>“I consider the Crossfire Hurricane investigation a massive system failure by senior leadership, but not representative of the dedicated, hardworking patriots who protect our nation every day at Federal Bureau of Investigation and the Department of Justice.</strong></em></p>
<p style="padding-left: 40px;"><em><strong>“As chairman of the Senate Judiciary Committee, I have decided to release all transcripts of depositions involving the committee’s oversight of the Crossfire Hurricane investigation. We have released as much material as possible, but some classified material has still been withheld.</strong></em></p>
<p style="padding-left: 40px;"><em><strong>“I appreciate all those who participated in the depositions and their candor. They have charted a path to allow us to reform the system.</strong></em></p>
<p style="padding-left: 40px;"><em><strong>“I believe that Crossfire Hurricane was one of the most incompetent and corrupt investigations in the history of the FBI and DOJ.</strong></em></p>
<p style="padding-left: 40px;"><em><strong>“The FISA court was lied to. Exculpatory information was withheld on those being investigated. The investigators, with some notable exceptions, were incredibly biased and used the powers of law enforcement for political purposes. The subjects of the investigation had their lives turned upside down. It is my hope that counterintelligence investigations will be reined in and this never happens again in America.</strong></em></p>
<p style="padding-left: 40px;"><em><strong>“The leadership of the FBI under Comey and McCabe was either grossly incompetent or they knowingly allowed tremendous misdeeds. There was a blind eye turned toward any explanation other than the Trump campaign was colluding with foreign powers. At every turn the FBI and DOJ ran stop signs that were in abundance regarding exculpatory information.</strong></em></p>
<p style="padding-left: 40px;"><em><strong>“The FISA warrant applications against Carter Page were a travesty, and those who signed them have acknowledged that if they knew then what they know now, they would not have signed it.</strong></em></p>
<p style="padding-left: 40px;"><em><strong>“It is hard to believe that the senior officials at the FBI did not know that the Steele Dossier had been disavowed by the Russian subsource. It is equally hard to believe that the warnings from the CIA and other agencies about the reliability of Christopher Steele and the dossier were not known to senior leadership. It is my hope that the Durham report will hold those accountable for the travesty called Crossfire Hurricane.</strong></em></p>
<p style="padding-left: 40px;"><em><strong>“There was no ‘there’ there. The investigation was pushed when it should have been stopped and the only logical explanation is that the investigators wanted an outcome because of their bias.</strong></em></p>
<p style="padding-left: 40px;"><em><strong>“Former FBI Director Comey and his deputy Mr. McCabe, through their incompetence and bias, have done a great disservice to the FBI and DOJ, and the senior DOJ leadership who signed off on the work product called the Crossfire Hurricane investigation have created a stain on the department’s reputation that can only be erased by true reform.</strong></em></p>
<p style="padding-left: 40px;"><em><strong>“I hope that the media will look closely at what happened and examine these documents, but I am not holding my breath.</strong></em></p>
<p style="padding-left: 40px;"><em><strong>“I appreciate the hard work of Inspector General Horowitz who uncovered the massive abuses of Crossfire Hurricane. His team should be proud of the work they did, as it will be used over time to reform the DOJ and FBI.</strong></em></p>
<p style="padding-left: 40px;"><em><strong>“I’m proud of the Judiciary staff and the work product produced by the Senate Judiciary Committee. I am disappointed that Democrats did not take it more seriously, but I do believe what the committee did will pave the way for much-needed reforms regarding future investigations.</strong></em></p>
<p style="padding-left: 40px;"><em><strong>“I will be pursuing reforms of counterintelligence investigations and warrant applications, and hope that my Democratic and Republican colleagues can find common ground on these matters. I also hope and expect that FBI Director Wray will continue the reforms he has started. It is hard to believe that something like Crossfire Hurricane could have happened in America.</strong></em></p>
<p style="padding-left: 40px;"><em><strong>“The bottom line is that going forward we must have more checks and balances when it comes to political investigations. We must have more meaningful sign-offs on warrant applications, and we need to restore the trust to the American people in this system.”</strong></em></p>
<p style="padding-left: 40px;"><em><strong>The committee released 11 transcripts of bipartisan staff interviews conducted from Tuesday, March 3, 2020 to Thursday, October 29, 2020.</strong></em></p>

<p>&#8212;</p>
<p><b>WASHINGTON</b> – Today, as part of the Senate Judiciary Committee’s ongoing investigation into the Crossfire Hurricane investigation and related FISA abuses, Chairman Lindsey Graham (R- South Carolina) released two recently declassified documents that significantly undercut the reliability of the Steele dossier and the accuracy and reliability of many of the factual assertions in the Carter Page FISA applications.</p>
<p><b>“I’m very pleased the investigation in the Senate Judiciary Committee has been able to secure the declassification of these important documents,” </b>said Chairman Graham.<b> “I want to thank Attorney General Barr for releasing these documents and allowing the American People to judge for themselves.</b></p>
<p><b>“What have we learned from the release of these two documents by the Department of Justice? Number one, it is clear to me that the memo regarding the FBI interview of the primary sub-source in January 2017 should have required the system to stop and reevaluate the case against Mr. Page.</b></p>
<p><b>“Most importantly after this interview of the sub-source and the subsequent memo detailing the contents of the interview, it was a miscarriage of justice for the FBI and the Department of Justice to continue to seek a FISA warrant against Carter Page in April and June of 2017.</b></p>
<p><b>“The dossier was a critical document to justify a FISA warrant against Mr. Page and this DOJ memo clearly indicates that the reliability of the dossier was completely destroyed after the interview with the primary sub-source in January 2017. Those who knew or should have known of this development and continued to pursue a FISA warrant against Mr. Page anyway are in deep legal jeopardy in my view.</b></p>
<p><b>“Secondly, the comments of Peter Strzok regarding the February 14 New York Times article are devastating in that they are an admission that there was no reliable evidence that anyone from the Trump Campaign was working with Russian Intelligence Agencies in any form.</b></p>
<p><b>“The statements by Mr. Strzok question the entire premise of the FBI’s investigation of the Trump Campaign and make it even more outrageous that the Mueller team continued this investigation for almost two and a half years. Moreover, the statements by Strzok raise troubling questions as to whether the FBI was impermissibly unmasking and analyzing intelligence gathered on U.S. persons.</b></p>
<p><b>“These documents, which I have long sought, tell a damning story for anyone who’s interested in trying to find the truth behind the corrupt nature of the FBI’s investigation into the Trump campaign in 2016 and beyond.”</b></p>

<li>This document not only demonstrates how unsubstantiated and unreliable the Steele dossier was, it shows that the FBI was on notice of the dossier’s credibility problems and sought two more FISA application renewals after gaining this awareness.</li>

<li>The document reveals that the primary “source” of Steele’s election reporting was not some well-connected current or former Russian official, but a non-Russian based contract employee of Christopher Steele’s firm. Moreover, it demonstrates that the information that Steele’s primary source provided him was second and third-hand information and rumor at best.</li>
</ul>
<ul>
<li>Critically, the document shows that Steele’s “Primary Sub-source” disagreed with and was surprised by how information he gave Steele was then conveyed by Steele in the Steele dossier. For instance, the “Primary Sub-source”: did not recall or did not know where some of the information attributed to him or his sources came from; was never told about or never mentioned to Steele certain information attributed to him or his sources; he said that Steele re-characterized some of the information to make it more substantiated and less attenuated than it really was; that he would have described his sources differently; and, that Steele implied direct access to information where the access to information was indirect.</li>
</ul>
<ul>
<li>In total, this document demonstrates that information from the Steele dossier, which “played a central and essential role” in the FISA warrants on Carter Page, should never have been presented to the FISA court.</li>
</ul>
<p>The second document contains <img decoding="async" src="https://www.theblackvault.com/images/pdf.gif" /> <a href="https://documents2.theblackvault.com/documents/senate/AnnotatedNewYorkTimesArticle.pdf">Peter Strzok’s type-written comments</a> [5 Pages, 2MB] disagreeing with assertions made in a <i>New York Times</i> article about alleged Russian intelligence ties to the Trump campaign.</p>

<li>The document demonstrates that Peter Strzok and others in FBI leadership positions must have been aware of the issues with the Steele dossier that the FBI’s interview with Steele’s “Primary Sub-source” revealed, because Strzok commented that “[r]ecent interviews and investigation, however, reveal Steele may not be in a position to judge the reliability of his sub-source network.”</li>
</ul>
<ul>
<li>The document further shows that the FBI’s assertion to the FISA court that “the FBI believes that Russia’s efforts to influence U.S. policy were likely being coordinated between the RIS [Russian Intelligence Services] and Page, and possibly others” appears to be a misrepresentation. This is because, in his comments on the <i>Times</i> article, Strzok asserts that “[w]e have not seen evidence of any individuals affiliated with the Trump team in contact with IOs [Intelligence Officials]. . . . We are unaware of ANY Trump advisors engaging in conversations with Russian intelligence officials.”</li>
</ul>
<ul>
<li>The document also indicates that the FBI may have been using foreign intelligence gathering techniques to impermissibly unmask and analyze existing and future intelligence collection regarding U.S. persons associated with the Trump campaign: “Both the CIA and NSA are aware of our subjects and throughout the summer we provided them names and selectors for queries of their holdings as well as prospective collection.” The quote does not provide enough information to fully understand exactly what the FBI was doing but impermissible unmasking and analysis of existing and future incidental intelligence collection of U.S. persons would be troubling.</li>
</ul>
<ul>
<li>The document also raises questions as to whether the FBI was properly using intelligence techniques and databases “throughout the summer” considering that the earliest formal investigation of a U.S. person associated with the Trump campaign was not officially opened until July 31, 2016.</li>
