Kagan Lies in Report to Fight Ban on Partial Birth Abortion

As the 2012 election is now over, Barack Obama has won a second term. Many wonder how his policies, his administration, and how the entire political arena, will change our future.

Did anyone catch the edge-of-your-seat thriller, Kagan's nomination hearings?

Well in case you missed it (a la Senator Al Franken who slept through it, on camera), there were 2 interesting exchanges.

One was when Kagan was asked if she would call herself a Liberal Progressive along the lines of O'bama. She hesitated, thought, then stuttered, and eventually changed the subject. No answer.

Then she was asked if (i.e. under O'bama's healthcare plan) she thought it was constitutional for the government to dictate what we eat. Again we got stuttering, evasiveness, and a non-answer.

Hmmm. Interesting.

Well anyway, let's just add the little nugget below to the pile of lovely things we are seeing uncovered about O'bama's pride and joy, Elena Kagan. And this has serious implications! Please read it. Admittedly it's a blog. I received this in an email and frankly I haven't even looked to see if there is a "better," "more official" write up. Obviously though, if this is true, the backlash should be enormous.

Looks like Kagan has taken a page straight from the Liberal Progressive (and global warming) book: If the facts don't support your agenda, just make up your some "facts" of your own.

Kagan made up “scientific facts” regarding partial birth abortion

Promoted from the diaries

In 2000 the Supreme Court struck down Nebraska’s PBA ban, citing a statement from the American College of Obstetricians and Gynecologists that PBA might be the best choice for a woman under certain circumstances. That statement was also used later to fight against a federal PBA ban signed by Bush. We now find out that the ACOG didn’t come up with that language - just the opposite initially in fact - Elena Kagan just made it up and it got inserted into the final report.

Shannen Coffin was a Deputy Attorney General under Bush who was involved in defending the federal PBA ban. Yesterday he wrote this piece for NRO, which today Powerline is calling a possible smoking gun.

The initial ACOG report said there was no situation under which PBA would be the only option. Kagan knew ACOG’s position that PBA was almost never necessary would be a disaster to the abortion on demand crowd, so she came up with language that made it sound like a perfectly reasonable choice. That language was inserted into the final report and then used as a club in future court cases.

As Mr Coffin sums it up…

Miss Kagan’s decision to override a scientific finding with her own calculated distortion in order to protect access to the most despicable of abortion procedures seriously twisted the judicial process. One must question whether her nomination to the Court would have the same effect.

And John Hinderacker sums up the situation as…

Unless there is some other interpretation of these documents that does not occur to me, it appears that Elena Kagan participated in a gigantic scientific deception. On behalf of the Clinton White House, she deliberately subverted what was supposed to be an objective scientific process. The ACOG report was certainly seen in that light by the federal courts.

Federal Judge Richard Kopf was deeply impressed by the scientific integrity of the report; he wrote:

“Before and during the task force meeting,” he concluded, “neither ACOG nor the task force members conversed with other individuals or organizations, including congressmen and doctors who provided congressional testimony, concerning the topics addressed” in the ACOG statement.

This statement was obviously false. The federal courts were victimized by a gross deception and a perversion of both the scientific process and the judicial process, carried out, the evidence appears to show, by Elena Kagan.

If this is how Kagan is willing to manipulate facts, one can only shudder to imagine what sort of activism she would bring to the Supreme Court.

Kagan’s Role in Blocking Partial-Birth Ban Exposed
by Connie Hair
07/16/2010

Sen. Jeff Sessions (R-Ala.), top Republican on the Senate Judiciary Committee, met yesterday with Charmaine Yoest, President & CEO of Americans United for Life (AUL) to discuss evidence of Supreme Court Elena Kagan's central role in defeating a ban on partial-birth abortion.

Yoest delivered to Sessions the AUL's extensive ethics report covering Kagan’s activist role in defeating the ban on partial-birth abortion while working in the Clinton White House.

“Partial-birth abortion is a gruesome procedure. People strongly oppose it. AUL’s report provides a valuable perspective on the debate, its importance, the timeline of events, and the key role Ms. Kagan appears to have played in the outcome of the fight,” Sessions said of the report.

“President Clinton seems to have been disposed to sign the ban, and Ms. Kagan seems to have persuaded him to reverse that position,” Sessions continued. “In her testimony, Ms. Kagan clearly presented herself as a neutral staffer in the process, though this record suggests she was an active player in working to keep partial-birth abortion legal.”

The report takes a comprehensive look at the efforts to ban partial-birth abortion in which AUL played an active role.

“Americans United for Life is a respected independent organization with a long history of protecting the rights of the unborn. During the latter part of the 1990s, AUL was active in promoting federal legislation that would have banned partial-birth abortions. The debate over the legislation—in which Ms. Kagan played a major role—was intense, and the vote was much contested,” Sessions said. “I look forward to studying the facts carefully in an effort to fairly evaluate this contradiction.”

Kagan is a commie.
