Once again the Governments Lawyer the US Attorney General is usurping the Courts powers, this time in execution cases by getting to fast track convicts to their deaths.
| Quote: |
| In essence, the attorney general will be given the sole authority to “fast track” death penalty procedures, severely restricting the time condemned inmates have to appeal their convictions after their cases have been settled in state courts. |
| Quote: |
| The new rules constitute a flagrant violation of constitutional protections of due process, particularly the right of habeas corpus to seek relief from unlawful detention. They place life-and-death decisions affecting condemned death penalty defendants in the hands of the government’s top prosecutor. |
| Quote: |
| A study released in 2000 examining every capital conviction and appeal between 1973 and 1995—nearly 5,500 judicial decisions—showed that courts found reversible error in nearly seven out of ten capital cases during this period. |
| Quote: |
| The study also found that 7 percent of those whose convictions were overturned were also found to be not guilty of the capital crime. |

This combined with the Master Arrest Warrant and the Master Search Warrant allow the President the kind of dictatorial powers that none of the founding fathers wanted that high posistion to have. Remember this is not just the Bush II Administrations doing it is also the work of Congrees both Democrats and Republicans who were in collusion on this when they passed the PATRIOT Act's reauthorization. This is just the newest assault on prisoners rights as well as the rights of US citizens, but it is among the most dangerous. |

The following article link is about the protests in Sydney over the Bush II Howard meeting. While it is not about the USA directly it shows what could happen with the government's presidents anti-protest handbooks in play someday in the USA.

| Quote: |
The tone for Monday’s hearing was set by Rep. Ike Skelton, the Democratic chairman of the House Armed Services Committee, who announced at the outset that there would be “no disturbances” and that spectators who sought to demonstrate their opposition to the war would be “immediately escorted out.”
“Out they go!” he said. “No disturbances will be tolerated, and we mean that.”
Among those in the audience were members of the “Code Pink” protest group and other antiwar activists. As soon as they spoke up, Skelton ordered that they be removed by the Capitol police. He included in his ban “those who are displaying a sign.”
After four people had been dragged out of the chamber, including the nationally known antiwar campaigner Cindy Sheehan, Skelton announced that they would be prosecuted.
None of the dozens of congressmen and congresswomen on the platform raised any objection to the quashing of free speech. The scene gave a stark picture of the chasm separating the entire political establishment and the broad mass of the American people, who by a wide majority oppose the war, and who sought to express that opposition by voting the Democrats into power in the congressional elections ten months ago.

Here is something to let you get some sleep.....
There is NO handbook on the citizenry taking back control of their country!
They can wish it, they can want it, they can write manuals, they can even institute laws..... but it is ABUNDANTLY clear that no matter what the plan, law, or intention of the ruling body, if the PEOPLE decide they've had enough; THERE IS NO AMOUNT OF PREPORATION that can be practiced nor tried for that can stop a free people from achieving their goal... especially when a majority will have IT or DEATH. |

Here the problem with the citizens taking back control. This trend that I've been mapping in this thread is not purely political it is heavilly social in context with surges and ebbs involved but in the long run the beachhead is over taken by the surge. See the problem is the people of America while publically hating fascism actually tend towards falling into fascism a bit at a time. None of Bush's really insidious laws will be repealled, not by any party because of the pwoer involved. No citizens armed revolt will overthrow the a social trend, because for every revolution there is a counter revolution and in truth counter revolutionary social forces in this country are still growing and if I were to guess within the the next 120-150 yeas these will peak with an America that makes Rome and the Third Reich look nice in comparrison, before revolutionary social trends or revolutionary actions of violence start reversing the trend and slowly take a foot hold over a 20-50 year period.
The way to stop the fascist trend in it's track is to reverse the social trend. This can be done with elections, and good candidates but more importantly the people have to come to hold revolutionary beliefs and they must act on those social principles. To do this mass media and entertainment must change, video games must change, literature must change, the predominence of influences (from entertainment, to school, to home, to sports) upon people minds must be changed from those that promote violence and social injustice to those that promote peace and prosperity for all. People must get over the excuses they give for retaliations and power grabbing and what freedoms and rights the give up or abuse and work for the betterment of all not just their own community or country. If the social trend towards fascism does not change to a social revolutionary one America will fall just as the Romans did but it won't do so until decades of damge have been done to it's own people and the world at large. No militia or armed revolt today can stop society from pursuing a trend they subconsciously desire, only changing the influences to change societies desires can . |

A few months back we ran into the Ohio's lap dance issue which eventually passed into law despite protests from the grassroots group Dancers For Democracy.
This issue is now trying to be put on the november ballot by D4D and others. While this is generally a freedom of expression issue, and also the income and livelihood of some 12000 dancers statewide (+ 8000 realted jobs of child care and laundry etc.) and several million dollars in the resulting income & sales tax revenue ($50 million from liqour sales alone). And Ohio adult clubs registered over 25000 new voters in 2004.
http://www.progressohio.org/page/community/post/angelinaspencer/CQ4y
The issue then gets into the weirdness of Ohio politics. Back in 2006 the Green Party and SEP both tried to get candidates on the presidential ballot. To this they needed approximately 6000 signatures the SEP got over the mark and the Greens about 2 or three times that anount, both sides had their signatures disqualified bu the election board, though the SEP went out and got more signatures to beat the mark Blackwell denied them a place on the ballot. Now move to the Lap Dance issue the "Community Defense Act" (why iOhioneeded a new law like this is unknown the state already has 70 laws regulating adult entertainment) and the dancer's Vote No Comittee have gotten 382508 signatures but the election board has tossed all to the point where they are below the minimum requirement.
http://www.sentinel-tribune.com/default.asp?sourceid=&smenu=1&twindow=&mad=&sdetail=11089&wpage=1&skeyword=&sidate=&ccat=&ccatm=&restate=&restatus=&reoption=&retype=&repmin=&repmax=&rebed=&rebath=&subname=&pform=&sc=1895&hn=sentinel-tribune&he=.com
There is obviosouly three possible answers to this signature problem this time around
1) Fraud by the election board
2) People are afraid to put their signature on the issue
3) Fraud by the no vote committee.
But in light of the previous elections since 2004 it seems far more likely to be corruption in the state government than anything else, and seem to be anecedotal evidence of how easily the 2004 election was stolen.
Addendum to the above edited in 9-30-2007:
To place an Issue on the Ohio ballot requires 241,366 signatures or 6 percent of the total vote cast in the 2006 governor's race
http://www.ohio.com/news/top_stories/9930697.html
The minimum number of signatures for a presidential race in Ohio is 5000 signatures.
The SEP turned in 7900 in 2004
http://www.wsws.org/articles/2004/aug2004/ohio-a19.shtml
Addendum2 to the above edited in 10-1-2007
Ralph Nader had 11000 out of the 14473 signatures disqualified by the state in 2004

I remember you stating these interesting psychological and sociological issues before... While I DO admit to their validity in the 'book' sense, I disagree in the 'real world' sense.... BECAUSE.....
When I was young and HAD to deal with bullies and thugs in my neighborhood, I found that the ONLY way to deal with people who want to take everything, IS that you HAVE to make the repercussions SO bad that THEY don't want to take the risk! You HAVE to make them understand that YOU and YOUR'S are NOT easy prey and that they must go elsewhere. IF you do not, then they WILL come and get you!
That's just a little analogy of HOW things really work. IF the government is NOT afraid of 'what' WE as a people will DO, then they WILL come and get it! |

I do not deny people rise up against governments, nor that Americans may rise up. However, the stresses that normally cause rebellion aren't overly abundant in American society. There are tensions that flare but not the ones that bring about full blown civil war. And personally I am thankful those stresses are not there in abundance, it gives the people room to affect change within the rule of law without resorting to killing each other in massive numbers.
In just about any political dispute in the USA there will be somewhere between 30% and 60% that are in opposition to an issue. Yet this movement towards a fascist state isn't regular ebb and flow dynamics, its more akin to Cape Cod's problems faster erosion on the back side and slower fill in inside the bay. The topography of the politics in the USA is changing. We see a politically fascist move and sometimes a counter move against it but all the while each successive move changes a generation's perception of what is acceptable behavoir for a government or its branches. While this sort of change has helped with cultural tolerance at the same time fascist-like laws have become increasingly stronger with much of the publics support, after all America is a lawsuit happy nation. The disparity between the rich and the poor's income is greater than ever and continues to grow, yet there is very little complaint, quite the opposite we place the rich on pedestals as what everyone should strive to be, we accept their failings as a personal problem, and their conspicous consumption as socially acceptable behavoir. This is slowly giving way to having an aristocracy and nobility as the normal state of things, what some would even call the natural state of things where certain famalies/people were meant to lead and rule and others to follow and serve. We are living within in an American social movement where there is very little change to stop the perception fascist moves as bad, and future generations will continue to be socialized in accepting the "natural order" of fascism. |

| Okay I can accept that. With the exception, that in 'some cases' there will be a reaction 'outside' the normal boundaries of reactionary analysis. Which ARE the circumstances of which I speak. THESE are things that will change the world as we know it. AND IT has changed as well. |

| Quote: |
| WASHINGTON — Ohio and Florida, which provided the decisive electoral votes for President Bush's two razor-thin national election triumphs, have enacted laws that election experts say will help Republicans impede Democratic-leaning minorities from voting in 2008. |
| Quote: |
| In the past, Ohio voters were entitled to an official notice and a hearing before an election board could declare them ineligible, but the new law says that the board can make that decision without notice. A disqualified voter who shows up at the polls must demonstrate that he's fixed any eligibility problem or opt for filing a provisional ballot that may not count |

The sunsetting Protect America Act which shredded the 4th Amendment and allowed the President unprecedented powers in warrantless wiretapping has had a new more permenant bill introduced in Congress by the DEMOCRATS.
Under it no longer will warrants be required in wiretapping international calls (includes E-mails and probably webposting), Only a periodic quarterly review of the searches by Congress and the FISA court. There is also talk of making telemunication industry immune from prosecution for assisting the Govt. including retroactively.
While the supporters are of the opinion that not allowing the president these powers is giving "Fourth Amendment Rights to Terrorists", it is my firm opinion that is what the Fourth Amednment was originally about. The period before our revolution allowed warrantless searchs by British Govt's trroops and law enforcement and that power was abused over and over again even before they started searching for the American terrorist & smuggler underground that led the American Revolution. In effect the fourth amendment was not only created to prevent abuses of search and seizure laws but to also give some minor protection to patriotic Americans underground forces if the governement turned despotic or was retaken by British loyalists.
We, as Americans, cannot change the word "terrorist" to solely mean "Islamic Fundamentalist Terrororist" or "Al Qeada" because sooner or later whether we like it or not we will be faced with homesbred white christian & jewish American domestic terrorists who will use the same bloody merciless tactics as the current crop of foreign ones do and the governemnt will crash down on Americans in the pursuit of the domestic group gaining more power and abusing more and more powers along the way. Realize now that there is always a slim chance that a new domestic terrorist could actually be the freedom fighters when our governement is no longer our government but has fallen into a fascist dictatorship of unthinkable power. Every 2nd Amendment lover right or left out there should be worried to death about warantless wiretapping. Every protest organizer should be worried about infiltration and wary that outside help is now compromised. Remember we could not win the Revolutionary War without France going bankrupt and eventually falling) supplying us, and remember the CSA fell because it's ambassodors to england and mail were intercepted by the USA's Government. Remember how long it took for news of the holocaust to be confirmed out of NSDAP controlled Germany, and by then it was almost too late. Outside communication is essential to maintaining liberty.
The FISA court while sweeping in power allowed a form of legal due process to take place and attempt to stop presidential & police abuse of power, now DEMOCRATS have introduced the legislation that will lead to it. It's time to write representative and senators folks again to stop this nonsensical fear. Because every time we let fear and terror of the enemy pass laws we let the terrorists win and our government slips more and more towards being a fascist dictatorship.

Yes 911 sure worked wonders for the traitors of freedom! (See Video : "Mohamad Atta and the Venise Flying Circus"!) Full speed ahead down the road to tyranny, maybe that light at the end of the tunnel, is a freight train coming at us? Talk about 30 days of darkness!

DEMOCRATS have bowed to Wall Street and let tax loop hole stay in. In another move to keep the wealthy elite firmly entrenched in their social and political position over the average American, a proposition to close a major tax loop has been defeated.
| Quote: |
Contributing to the massive fortunes of these managers is a tax system that allows them to count the bulk of their income, paid out as a share (normally 20 percent) of the profits from deals made by the funds, as “carried interest,” which is taxed at the capital gains rate of 15 percent, instead of the 35 percent rate that applies to the highest income tax bracket.
This top bracket, it should be noted, is itself at a near-historic low. As recently as 1980, income over $215,000 was taxed at 70 percent, and throughout most of the 1950s and early 1960s, income over $200,000 was taxed at 91 percent.
The Wall Street executives have claimed that they are entitled to the 15 percent rate because of the risks they take on investments. In fact, the vast bulk of the money at risk is that of their investors, for whom they provide a service as money managers, and are compensated for it, just as others who pay ordinary income taxes.
The main legislative proposal put forward in the House of Representatives would have compelled the super-rich fund managers to report their earnings as regular income and pay the 35 percent rate. It has been estimated that the measure would have created at least $6 billion in additional federal revenues.
According to the Washington Post, however, the Senate’s Democratic leadership has already assured the billionaire and multi-millionaire financiers that would be affected by the measure that they have nothing to worry about.

Normally I don't say bad things about Taser or other LTLW use, I think such things are valuable as a replacement for lethal weapons. But every onece in awhile the police go overboard especially when politics are involved.
Taser use and abuse has become all too common. If someone give the a cop too much attitude for his or her taste out comes the the taser and zap. Now think about that, tasers were meant to prevent the use of firearms when less force was required, could you imagine mouthing off and getting shot by the standard 9mm Glock for not shutting up?
The Andrew Meyers/John Kerry incident is the case in point. The police decided not to escallate the conflict with hard empty hand strikes, kicks, knees or baton. Anyone who has watched the video of the incident knows Meyers was not even a threat for those kinds of abuse yet zapping with 50000 volts in front of an audience was okay? Note that he was obviously being handcuffed when it happened. http://www.youtube.com/watch?v=6bVa6jn4rpE The Taser does have deaths connected with it for various reason so cautionary use should prevail, but police have learned to abuse the law with LTLW and now the Florida Department of Law Enforcement is backing up the police's abusive tactics.
http://www.commondreams.org/archive/2007/10/25/4804/
Questioning authority and resisting arrest through non violent means results in a crack down by authorities. How long will it be before the USA sees a White Rose incident.
http://en.wikipedia.org/wiki/White_Rose
PS: One thing that disturbs me greatly about this incident and other is the fact that nobody stands up for the oppressed at the incidents and makes a citizen's arrest of the police for assault and breach of fiorst amendment rights. This is what is truly sad about our march into the FSA, we let it happen. |
